The connection between the articles is that both of them treat different sides of one crime, which is trademark counterfeit. the first article stipulates for penalties for trademark counterfeit (art. 702) and the second article relates to sanctions imposed in case of fraudulent competition. It goes without saying that when a trademark counterfeiter sells counterfeit goods bearing the trademark, he will be subject offending both articles. That is why the court saw that the offense is connected to both articles. My problem is that I need a translation that is comprehensible to Swiss lawyers.

Fuller context is needed. What is the other article? What are the penalties? How has the "connection" affected the decision? If the sentence is a prison term, was the defendant handed two terms back to back, for example? The devil is in the detail.

First off, the object of the Arabic sentence needs to take the accusative case:

كما تشكل هذه القضية اجتماعاً معنوياً

As to rendering it in English, I would rely on your explanation and suggest the above.

I could think of many ways to "fix" the Arabic, if we could only be sure of what it means. As I stated above, my answer was entirely based on the the asker's rexplanatio given in her added note. The text itself remains an enigma.

Correspond in spirit

As it's said sometimes. They follow روح القانون . So what the writer means is that the crime "corresponds in spirit" with the article of the Law; meaning that maybe all the circumstances do not match, but on the overall, there's a match.

This sentence needs to be turned around to make sense in English, thus you actually need to provide the whole sentence, as while I understand what you're hinting at, the whole sentence needs to be given in context to see how the sentence has to be turned around.
As Fuad pointed out, the Arabic itself is incorrect grammatically.
Another possibility is this "this case is punishable under article * of the * code/law and article * of ..."
