The Civil Procedure Code and Organisation of Common Courts Amendment Act 2004, which entered into force on 6th February 2005, introduced, in place of cassation against non-final second-instance court judgments and procedural decisions, the institution of the so-called cassation complaint. Such a complaint is a legal remedy initiating review of the legality of final decisions issued by civil courts (cf. Article 398 1 of the Civil Procedure Code).

Cześć Frank. Nie, myślałem o jakiejś korekcie Twojej odpowiedzi, aby rozróżnić apelację i kasację. Jeśli masz jakiś pomysł, to może wykorzystaj to, co tu wyszukałem albo skorzystaj z jakiegoś innego źródła. Myślę, że to rozróżnienie jest konieczne z uwagi na polskie przepisy. Pozdrawiam serdecznie.

KPC Art. 398 (20). Związanie sądu wykładnią prawa dokonaną przez Sąd Najwyższy

Sąd, któremu sprawa została przekazana, związany jest wykładnią prawa dokonaną w tej sprawie przez Sąd Najwyższy. Nie można oprzeć skargi kasacyjnej od orzeczenia wydanego po ponownym rozpoznaniu sprawy na podstawach sprzecznych z wykładnią prawa dokonaną w tej sprawie przez Sąd Najwyższy.

Any appeal (on objections or fact or law) against the decision of the district court must be lodged with the Court of Appeal within 14 days. The appeal must be delivered to the other party who has 14 days to file a response to the objections raised.
The Court of Appeal can carry out a limited evidence procedure, provided that the applicant can show that they were unable to file motions as to evidence in the first instance proceedings. If the value of the claim is not lower than PLN50,000, it is possible to lodge (an appeal for cassation) with the Supreme Court within two months of the Court of Appeal decision.

Apelacja i kasacja to dwa różne pojęcia prawne. Apelacja jest procedurą odwoławczą wobec wyroku sądu, natomiast kasacja dotyczy sytuacji po zakończeniu postępowania w danej sprawie.

Skarga kasacyjna przysługuje od wydanego przez sąd II instancji prawomocnego wyroku lub postanowienia w przedmiocie odrzucenia pozwu albo umorzenia postępowania kończących postępowanie. Może ją wnieść także Prokurator Generalny, Rzecznik Praw Obywatelskich lub Rzecznik Praw Dziecka. Wnosi się ją do Sądu Najwyższego.

Przytoczenie w skardze kasacyjnej pierwszej podstawy wymaga wskazania, poza naruszonymi przepisami, także sposobu ich naruszenia (błędna wykładnia lub niewłaściwe zastosowanie) oraz wyjaśnienia na czym polega błędne zrozumienie lub subsumcja przepisów. Uzasadnienie pierwszej podstawy nie może polegać na wykazywaniu wadliwości ustaleń faktycznych, gdyż do tego celu służy druga podstawa skargi kasacyjnej.
