Hello,

Chef du Monde / Grupo Asis owes me over 6k euros. What's the best method to colect a debt in Spain in general, or from this agency in particular?

The only method I know of is the European Small Claims procedure but it covers only claims up to EUR 5 000. Are you talking of several invoices or just one? I heard of cases of translators who filled out form A of the European Small Claims procedure and send it to their client. Enough done!

Several invoices Sep 26, 2024

it's several invoices, none more than 5k. I'll try that in early October - the client said they would pay in September, and we're still on the 26th

Same problem Sep 26, 2024

I have the same problem with the same agency. I filled a European Small Claims procedure, sent it to the agency, that never replied, and to the court in Zaragoza, that never replied either...

Any debt collection agency were you actually only pay something after receiving something?

I've been having the same issue with the same company. How many people would we need to enact a class action suit? I'm currently owed about €1500 for over a year now. They just keep telling me to resend the invoices and the payment will go out the next month. Very frustrating. Also, can we blacklist them here?

If you are sure that this is an active registered business, report them to the Spanish tax authorities. Since you both are not from Spain (right?), give them a hint on possible shady foreign transactions practices.

Just whisper "IRS" and see how quicky a US business will get its act together.

How long before a debt is written off in Spain? Payment claims in Spain have a limitation period of 5 years, which applies as soon as the invoice is due and payable. There are some exceptions whereby different limitation periods apply.
