Spanish term
la fecha de la devolución no fueren del dominio público
Spanish to English
Other
Law: Contract(s)
I am a little confused about this sentence. Any suggestions as to how to translate it? Spanish to English (my attempt is in English).
Dentro de los 5 días siguientes a la terminación del presente contrato, LA VENDEDORA se obliga devolver toda aquella Información Confidencial, que llegara a tener en su poder, y que a la fecha de la devolución no fueren del dominio público, en el entendido que durante la vigencia y aún con posterioridad a la terminación del presente contrato, no podrá usar o divulgar a terceros la Información Confidencial.
Within 5 days following the termination of this agreement, THE SELLER must return all Confidential Information in its possession. It is understood that the return may not be made publically and that said Confidential Information may not be used or divulged to third parties while this contract is effective and after its termination.

The Spanish text is poorly written, and it seems to me that the phrase in question adds nothing to the meaning: "up until the return date" says exactly the same as "during the validity of the contract", so I suggest a reformulation something like this:
"Within 5 days after the date of termination of this contract, THE SELLER is obliged to return all Confidential Information she may have in her possession, the understanding being that during the validity of this contract and even after its termination, she may not use, make public, or divulge said Confidential Information to third parties."
Good luck with it :)

OR:
"WHICH NOT HAD BEEN MADE PUBLIC ON/BY THE DATE OF RETURN"
I'd say there are a few "typos" in the original version: "... se obliga devolver" should "se obliga A devolver" + "... toda aquella información... que no FUEREN (in plural?) del dominio público". This should be "FUERE" since it's talking about information (in singular)
