De la simple lectura de las definiciones antes referidas, se desprende que el agente actúa "en nombre del" XXX, pero no se establece de manera expresa que forzosamente deba actuar también "en representación del" mismo.

in other words ... the agent is authorized to do everything (the ground work) and then represent his/her client (who can keep out of things completely and jusy pay up :))

: Creo que por acá viene la cosa, en este caso hay que hilar muy fino. S/alguna doctrina el mandato civil puede encontrarse o no acompañado por la representación. A veces las cosas no son tan simples como parecen...Saludos!

Es otra opción dada la distinción que hay que hacer con la facultad de representación. La diferencia entre actuar en nombre de y representar plenamente van por el lado de las obligaciones que se contraen entre las partes.
