3. What happens if the deceased did not grant a will in Spain or elsewhere?

When somebody dies without having any will, they are “intestate”. If an intestate person leaves assets in Spain, the heir will have to obtain a **declaration of heirs**:

If the heir is the deceased’s spouse, descendant or ascendant, this declaration can be obtained from a Notary (it first having been proved who, under the law of the deceased’s nationality, is entitled to inherit); and
Where the heir is another relative (or not a relative at all), a court order will be needed.

La declaración de herederos, es una situación jurídica que se produce después de la muerte del causante, herederos que pueden señalarse mediante testamento o en el caso de que no existan herederos forzosos, legítimos y legatarios, mediante declaración judicial de herederos, para ello debe contar siempre con un Abogado especialista en Testamentos o en su caso de Declaración de Herederos.

En la herencia confluyen una serie de elementos jurídicos que hay que destacar, en primer lugar, la pregunta de quienes son los herederos forzosos, es necesario responderla, así como los herederos legítimos, que me corresponde heredera, cual es la masa hereditaria, si uno de los hijos ha premuerto, quien hereda en su lugar, etc., todas estas preguntas, tendrán su respuesta a continuación, no obstante, para cualquier pregunta sobre el tema, no dude en consultar con nuestros Abogados especialistas en herencias.

a (notarial) declaration of heirs > (E&W) judicial finding of heirship > in favour of .. children

cf. Sandro T's formulation that highlights that it is the court that makes the 'judciial determination of heirship' in favo(u) of the (AE) decedents heirs.

It also depends on the readership. City of London scrivener-linguist notaries weaned on Brooke's Notary expect a literal translation.
