Estoy traduciendo al inglés británico una resolución interlocutoria que dicta una medida cautelar de innovar, y este párrafo trata sobre el peligro en la demora (danger in delay).

Con relación al peligro en la demora, la doctrina coincide en señalar que el dictado de medidas cautelares responde a la necesidad de evitar aquellas circunstancias que en todo o en parte impiden o hacen más difícil o gravosa la consecución del bien pretendido, o en cuya virtud el daño temido se transforma en daño efectivo. Pero tales acontecimientos, si se registraran, ocasionarían directamente la frustración. Por lo tanto, es lícito obviar la espera y dispensar la certidumbre absoluta ante el supuesto que **la actuación normal del derecho llegara tarde**. Alcanza con el temor del daño, pues ello configura un interés jurídico que justifica el adelanto jurisdiccional. Este legítimo interés en obrar proviene del estado de peligro en el cual se encuentra el derecho principal.

This is a free rendering, but it seems to express the intended meaning in Spanish. "Might come too late" conveys the idea, but strikes me as a bit awkward for a formal legal text.

Performance, in law, act of doing that which is required by a contract. The effect of successful performance is to discharge the person bound to do the act from any future contractual liability.
Each party to the contract is bound to perform promises according to the stipulated terms. In case of any controversy as to the meaning of a promise, the courts have usually decided that a person must perform it as the other party reasonably understood it to be. Thus, a preference for the rights of the one who is to receive the benefit of the promise is established.

Attempts to establish hard and fast rules about reasonable interpretations of promises are now discouraged. Although at one time a person would be held to the literal meaning of the contract provisions stating a promise, the requirement now is to perform the true meaning and intent of the contract, which may not correspond with the fine print.

I think that derecho in this context is a right, not the law or a legal process. The last sentence of the paragraph mentions the interest to act due to the present danger in which a right is found: … en el cual se encuentra el derecho principal.

Por lo tanto, es lícito obviar la espera y dispensar la certidumbre absoluta ante el supuesto que la actuación normal del derecho llegara tarde. Este legítimo interés en obrar proviene del estado de peligro en el cual se encuentra el derecho principal.

Therefore, it is permissible to eliminate the delay and bestow absolute certainty in the event that the normal course of action for a right would be dead on arrival. This legitimate interest to act comes from the state of danger in which the principal right is found.
