Spanish to English Bus/Financial Insurance
Hi all,

I can't figure out this sentence and I was wondering if somebody could decipher it!

It is the "que nacería frente a..." bit that stumps me.

Thanks!

Adrian MM. Jun 17, 2019:
Empresa de ingeniería Unless I'm mistaken, la empresa and la ingeniería are one and the same.
philgoddard Jun 17, 2019:
The only thing I'm not sure about is "ingeniería", which is not part of the question. "Engineering company" fits the context, but I can't find any dictionary evidence for it. However, I'm sure Nicholas can confirm from the rest of the document whether that is the meaning.

risk of default on such claim as would arise against....

I thought claim was - besides (credit) facility, loan or advance - a standard translation for 'crédito', but apparently not.

Arise against > as opposed to the copout of: vis-à-vis...

Under the Bonding Ins. Pol., the company covers (is to indemnify) the bond-issuing bank for non-payment (cf. dishono(u)r of a check/ cheque etc.) of such claim as would arise against the engineering (firm) in the event of enforcement of the bond.

Apologies if this appears like a weak answer.

Guarantee: (aval) bank>pays creditor on debtor's default
Indemnity: debtor>reimburses the bank for payment to> the creditor under the aval

The circular arrangement as I see it:

Under the Bonding Ins. Pol., the (engineering) company is to indemnify the bond-issuing bank for *the risk* of non-payment of such claim as would arise against such engineering (co.) in the event of enforcement of the bond....

I'm afraid I'm basing my answer on one website.

Contracting this policy the bond issuer covers the risk of default by the exporter on the credit that originates in favour of the issuer in case the bond is called.

'risk of non-payment of the credit payable to the engineering company, resulting from the enforcement of the bond/surety/guarantee'.

I don't usually translate financial texts so you would need to make the translation sound as though it was written by someone who knew what they were talking about!

Nacer = result in, but I can't think of a way of translating 'frente a'.

Here are the Spanish and English versions of the same text. I hope it helps!

The calling of any of the bonds for whatever reason by the importer or the foreign bonding bank originates a credit payable by the exporter to the Spanish bonding bank. In case this credit is not honoured as a consequence of any of the risks referred in the policy, CESCE shall indemnify the insured bank according to the terms established under the policy for the losses deriving from the total or partial default on this credit.

frente a = payable to :-)
Peer comments on this reference comment:

agree Adrian MM. : If you discount the 'deuda frente a' quotes and (mis-?)construe 'un crédito del exportador frente a...' as an exporter's claim against, then the rest should or - future subjunctive in Spanish - might fall into place.

As I understand it, the credit would have to be paid to the engineering company but I'm not confident enough to post an answer. Thank you, Adrian :-)
