wyłączenia podmiotowe
W odniesieniu do omawianej regulacji dyrektywa umożliwia państwom członkowskim wprowadzenie wyłączenia o charakterze podmiotowym dotyczącym przedsiębiorstw finansowych tj. instytucji finansowych i zakładów ubezpieczeń. Katalog podmiotów wchodzących w zakres pojęcia „przedsiębiorstwo finansowe” określa art. 2 pkt 5 dyrektywy.
