It would seem that both actus reus and mens rea are included in the supuesto. Therefore, I would use offense for this context with the possibility of using statute for others.

Presumption

A legal presumption is a conclusion based upon a particular set of facts, combined with established laws, logic or reasoning. It is a rule of law which allowing a court to assume a fact is true until it is rebutted by the greater weight (preponderance) of the evidence against it.

'supuesto' ordinarily means scenario. Here it means the elements of an offence as a whole, including the mens rea (or required degree of intention).
