Spanish term
Otrosí
Spanish to English
Law/Patents
Law (general)

: not in line with Anglo-Am. legal drafting practice.

Well an internet search will show dozens of examples of numbered claims in this format, so they must all be defective and liable to be struck out

: Don't see the relevance of "Anglo-Am" legal drafting in a question which concerns Australia.// only indirectly;

thanks Ms. Bramhall but there is some relevance

: It is an extension of the basic legal document and means "furthermore". Several "furthermores" can be added thus first, second, etc.

I agree with you and my suggestion doesn't contradict what you say

: A translation of otrosí can perhaps be omitted in the ST extract posted by Asker, but she will most likely need a translation for otrosí elsewhere in the text since it is used when cross-referencing between sections of the document.

Yes but I confined my suggestion to the Asker's short extract

In the (First, Second or Further, Third etc.) Alternative
Anglo-Am. legal drafting practice - lost on many initiates: In the alternative, in the first alt . or further and alternatively- In the first alternative, second further alt. etc.
Further or alternatively, it is averred that it was an implied term of the Contract that payment of the Commission for the Services would be paid within a reasonable period of time.
'Further, or alternatively, the Defendant has failed to pay the said invoices.
Further or alternatively, it is averred that the place of performance of the obligation by the Claimant as the commercial agent was its place of domicile namely the Registered Address'

additional pleading/request
I have recently translated a divorce case and I used this term. It worked in my document. I hope it works in yours-1

: A "pleading" is a document, not a head of claim or petition

Thank you for the clarification, then maybe “additional request” if they’re not talking about other documents (pleadings) that have been presented with the original document.

Jennifer Levey
: Agree with AT about 'pleading'. And even if a lay client might think of it as a 'request', their lawyer would use the appropriate legalese in Asker's context.

additional petition
Definition of otrosí from the Glosario de términos jurídicos published on the official website of the Chilean Judiciary: https://www.pjud.cl/docs/download/3180
The definition uses the terms petición and solicitud because, in the conventional language of the Chilean courts, everything addressed by the parties to the Court is (supposed to be...) couched as a 'deferential request' (similar to the English: 'May it please the Court to receive in evidence ...').
otrosís are like numbered chapter headings in a book - they mark the start of each new block of subject-matter on which the Court is being 'asked' to deliver a decision. And, just as the word 'chapter' gives no clue as to the content of the following text, so otrosí gives no clue as to the legal significance or purpose of what follows.
In practice, many ('most', in my own experience) otrosís are concerned with the presentation of documentary evidence, the accreditation of lawyers' mandates and other supporting details and it would be incorrect to label those as 'claims', or 'pleadings', or 'alternatives', etc.
In Asker's specific context, ... Primer otrosí: Acuerdo completo y suficiente is a clear indication that the document is being submitted jointly by both parties as part of a simplified process used in Chile to handle non-contentious divorces (mutual consent). Provided the Acuerdo completo agreed and signed by the parties in advance in the presence of a public notary provides sufficient guarantees concerning matters such as economic compensation, the share-out of property, child maintenance, etc., the Family Court judge can grant the divorce without any further discussion.
In that context, there is no 'claim', 'pleading' or 'complaint', there is no 'alternative', there is only a request to have the divorce ratified by the Court on the basis of the acuerdo completo and other documents presented in the Segundo otrosí.
IOW, not only is 'additional petition' a suitably generic translation of otrosí, it is also consistent with the overall intent of the parties, which is to seek ratification by the Court of the terms of their mutual agreement to terminate their marriage.

: "heads of petiton" would work, but not "petition" which is the term for a divorce proceeding as a whole (at least where I live)

The Principal is also a (the first, primary, ...) 'head of petition', and the Chilean lingo uses different terms to mark the essential structural and logical hierarchy of the document.

¿Qué son los otrosíes?
Proc.
--------------------------------------------------
Note added at 1 hr (2023-05-30 22:38:34 GMT)
--------------------------------------------------
