Art. 185 Venezuelan Civil Code
Es aquella que, verificada por un Juez, puede generar la disolución del vínculo matrimonial. Anteriormente, sólo podían alegarse las previstas en el Código Civil, pero por un cambio de criterio de la Sala de Casación Civil amplió tales posibilidades.
Artículo 185 del Código Civil:
“Son causales únicas de divorcio:
1º El adulterio.
2º El abandono voluntario.
3º Los excesos, sevicia e injurias graves que hagan imposible la vida en común.
4º El conato de uno de los cónyuges para corromper o prostituir al otro cónyuge, o a sus hijos, así como la connivencia en su corrupción o prostitución.
5º La condenación a presidio.
6º La adición alcohólica u otras formas graves de fármaco-dependencia que hagan imposible la vida en común,
7º La interdicción por causa de perturbaciones psiquiátricas graves que imposibiliten la vida en común. En este caso el Juez no decretará el divorcio sin antes procurar la manutención y el tratamiento médico del enfermo.
También se podrá declarar el divorcio por el transcurso de más de un año, después de declarada la separación de cuerpos, sin haber ocurrido en dicho lapso la reconciliación de los cónyuges.
En este caso el Tribunal, procediendo sumariamente y a petición de cualquiera de ellos, declarará la conversión de separación de cuerpos en divorcio, previa notificación del otro cónyuge y con vista del procedimiento anterior.” G.O.E Nº 2.990 del 26-07-1982.
Así, recientemente la Sala de Casación Civil del Tribunal Supremo de Justicia ha establecido que la incompatibilidad de caracteres y el desafecto son también causales de divorcio. Para más información, véase:
