Open Source Software” means any software provided by the Company where the software (a) contains or is derived in any manner (in whole or in part) from software that is distributed where any party can be a licensee without notice to the carrier or similar licensing or distribution models; or (b) software that is licensed pursuant to any of the following terms (i) any requirement for distribution of source code, (ii) any requirement for any patent non-assert or patent license by Motorola, (iii) any requirement for disclosure of any modifications to the software; or (iv) any attribution requirements other than to maintain notices within the source code of the software.
