"With more frequency, individuals conduct research and obtain factual information from Internet Web sites. It is well established that facts are in the public domain and,therefore,can be used by others without fear of liability under the Copyright Act. In accessing such information, however, individuals may not realize that the Web site owner has attached terms and conditions associated with the provision of the information. By accessing this information, individuals may be entering into an enforceable contract, under which they can be held liable for duplicating that information or forwarding it on to others. Such liability may exist even if the information accessed or obtained consists of factual information in the public domain.Thus, an individual who duplicates information in the public domain may be free from liability for copyright infringement yet may still be held liable under a breach-
of-contract theory. This article addresses the growing use of contracts in conjunction with information displayed on Web sites and the potential liability for violating the terms of such contracts.
Click-Wrap and ***Browse-Wrap*** Agreements and Their Enforceability
There are two variations of agreements employed by Web site owners in connection with the provision of information on their Web sites: click-wrap agreements and ***browse-wrap*** agreements.
3…the enforceability of ***browse-wrap*** agreements is more complicated. These agreements allow the user to view the terms of the agreement, but do not require the user to take any affirmative action before the Web site performs its end of the contract. Notice of the agreement usually appears on the homepage (often in the form of a link), and clicking on the notice links the user to a separate Web page containing the full text of the license agreement. The user is not required to click on an icon expressing agreement to the terms of the agreement (as in click-wrap agreements), nor is the user ever required to view the terms.The agreement is simply there for users to view if they wish, assuming that they can find it.

In this case, apparently the agreement appears in a scroll-down browser window with an "I accept" button under it, but (if I get the idea correctly) the user is not required to click on it to continue...
