English term

Enter Judgment (claimant be permitted to...)

English to French Law/Patents Law (general)
Bonjour à tous,

"General Form of Judgment or Order
(....)
Before Deputy District Judge [XX] sitting at the County Court Money Claims Centre [Address].
UPON reading an Application from the Claimant.
IT IS ORDERED THAT
****Claimant be permitted to enter Judgment.**** "

Je ne suis pas sûre de savoir comment rendre l'expression en référence. Je ne suis jamais encore tombée sur "enter judgment" accolé à "claimant".

Cela signifie t-il "qu'un jugement soit en rendu en faveur de..." ? Pourriez-vous m'éclairer s'il vous plaît ?

En vous remerciant !

English term (edited): (claimant be permitted to...) enter judgment
Selected

(le plaignant soit autorisé à) requérir/solliciter une décision (immédiate)

The claimant is indeed requesting a decision from the juge. This is usually when the facts of the case are not disputed; for instance, when the defendant has failed to appear or has admitted the claim. In the latter case, the claimant can apply for a specific amount to be awarded.

soliciter le jugement

Translating the mechanics of what actually happens in the English courts, the claimant in reality APPLIES for judgment to be entered and the court itself ENTERS the judgment

neutral writeaway : I've never encounterd soliciter le jugement used like this in any Fr doc I've translated. Any refs?

Indeed no, it is an English procedure with no direct French equivalent; but see Canada - olp.swlauriersb.qc.ca
